The Kerala High Court on Tuesday convicted Saritha S., accused in the solar scam cases. Nair sought response from the Enforcement Directorate (ED) on a petition challenging the order dismissing his plea for a copy of the statement made by the Ernakulam Sessions Court. According to the petitioner, the statement made by Swapna under Section 164 of CrPC was a public document. Therefore, she was entitled to get a copy of it.
Sarita’s lawyer argued that Sarita understood that some allegations would have been leveled against her in the statement made by Swapna.
When the petition came up for hearing, Justice Bechu Kurian Thomas asked how a statement could be a public document under Section 164 of CrPC. In fact, only the accused was entitled to get a copy of the statement after filing the final report, if he forms part of it.
