NEW DELHI: The Supreme Court on Tuesday said it will start the final hearing in the matter related to the constitutional validity of reservation from September 13. economically weaker section (EWS) in issues of higher education and public employment based on financial conditions.
The constitutional validity of the 103rd Amendment Act, 2019 that enabled the state to make reservations in matters of higher education and public employment only on the basis of economic parameters, will be the first matter to be examined by a five-judge bench headed by the chief. In addition, the public interest case will be heard along with a case filed by the Andhra Pradesh government against the Andhra Pradesh government’s decision to quash its 2005 decision to grant reservations in education and public service for the entire Muslim population of the state.
The court has listed both the cases for September 6 for direction and said that the final hearing will start from September 13.
Meanwhile, the court has appointed Shadab Farsati, Kanu Agarwal and as nodal counsel for viewing two other common collections. The court said that the common compilation should contain relevant submissions and case compilations. The court also clarified that it should contain only citations as well as an index of paragraphs and page numbers for reference to books. The court said the counsel for the arguments should submit written arguments of not more than three pages in time.
All the advocates are of the unanimous opinion that additional time is given to ascertain the total time taken to argue the cases. Shadab Farasat, Mahfouz Nazki, Kanu Agarwal and Nachiketa Joshi has been appointed as the Nodal Counsel.
