Ahead of Gujarat Elections, Kejriwal Promises to Implement Fifth Schedule of the Constitution in Tribal Areas

Aam Aadmi Party national convener Arvind Kejriwal on Sunday promised that the Fifth Schedule of the Constitution and the Panchayats (Extension to Scheduled Areas) Act will be implemented in the tribal areas of Gujarat if AAP comes to power in the state. Kejriwal also guaranteed that Gujarat’s tribal advisory committee would be headed by a person from the community instead of the chief minister, as has been the case in the state. The Delhi Chief Minister was speaking to reporters in Vadodara on the second day of his two-day visit to BJP-ruled Gujarat, where assembly elections are due later this year.

He will address a rally at Bodeli in Gujarat’s tribal-dominated Chhota Udaipur district later in the day. The Fifth Schedule of the Constitution deals with the provisions relating to the administration and control of Scheduled Areas and Scheduled Tribes.

The PESA Act was enacted by the Parliament in 1996 to ensure self-government for the people living in the Scheduled Areas. States were required to make rules for effective implementation of the Act to strengthen Gram Sabhas in Scheduled Areas.

Kejriwal said, ‘We will implement the provisions of the Fifth Schedule of the Constitution word by word. We will also strictly implement the PESA Act, which says that no government can take action in the tribal area without the consent of the Gram Sabha.”

“There is a tribal advisory committee. Its job is to monitor the development of tribal areas, how to use the funds. The law states that the tribal advisory committee should be headed by a tribal. In Gujarat, the chief minister heads the committee. It will be stopped,” he said.
