Pakistan President Arif Alvi administered the oath to Elahi at Aiwan-e-Sadar in the early hours of Wednesday.
Elahi of the Pakistan Muslim League-Qaid was supported by Imran Khan’s Pakistan Tehreek-e-Insaf (PTI). He was defeated by Hamza on 22 July after Dost Muhammad Mazari, deputy speaker of the Punjab Legislative Assembly, rejected 10 votes from his party. Hamza received 179 votes against Ilahi’s 176 after the PML-Q’s 10 votes were not counted in his favor.
Rejecting the votes, Mazari cited a letter from PML-Q chief Shujaat Hussain dropping support to Elahi. The decision tilted the balance in Hamza’s favor—an advantage that the Supreme Court reversed in its decision on Elahi’s petition.
In a brief order, the three-member bench declared all appointments made by Hamza “illegal” and asked his cabinet members to vacate the office. All advisors and assistants appointed by Hamza were also ordered to be relieved of their duties.
“We find that the comprehension and implementation of the said brief judgment as well as the provisions of Article 63A(1)(b) of the Constitution by the Deputy Speaker of the Provincial Assembly of Punjab, Lahore (Respondent No.1) were clearly wrong. and is wrong and cannot be sustained,” the order read.
The top court ordered a notification to be issued immediately to Elahi as the new CM of Punjab and directed the governor to administer the oath by 11.30 pm on Tuesday. If the governor does not administer the oath to Elahi, President Dr Arif Alvi can do so, the court ruled.
After the governor’s refusal, Elahi left for Islamabad late on Tuesday night to take oath from Alvi as ordered by the Supreme Court.
According to Geo News, President Alvi had sent a special plane to bring Elahi to Islamabad for the swearing-in ceremony.
The political crisis in Punjab began in February when a no-confidence motion against the then PM Imran was taking shape. To prevent the PML-N from taking charge of the province, PTI had offered the CM post to the PML-Q, which had 10 MLAs in the 371-member House, fearing it would join the opposition camp.
Eventually, the then PTI CM Usman Buzdar resigned from his seat to make way for Elahi as the joint candidate of the PTI-PML-Q. In the election, 25 PTI dissidents voted for Hamza, who received 197, 11 more votes than required for a simple majority.
On May 20, the Election Commission removed the disgruntled MLAs on charges of defection. Since these MLAs were no longer members of the Assembly, Hamza lost his majority. The bypolls for 20 seats were held on July 17, in which PTI gave 15 seats to the PML-N, while the PML-N got only four.
