CCI issues ‘stop and stop’ order against 6 firms found guilty of bid rigging

The Competition Commission of India (CCI) issued a final order on 29 October 2021 against six firms which were found to have indulged in cartelisation in the supply of Low-Density Poly Ethylene Cover (LDPE) to the Food Corporation of India (FCI). Directly or indirectly fixing prices, allotting tenders, coordinating bid prices and manipulating the bidding process.

However, the CCI acknowledged its modus operandi during the course of the investigation, recognizing that four of the six firms had filed applications for lesser penalties and admitted their conduct, thus cooperating fully with the CCI, no also refrained from imposing monetary fines.

Further, the firms were also MSMEs with limited staff/turnover and the prevailing economic situation arising due to the outbreak of COVID-19, put pressure on the MSME sector in the wake of the said pandemic.
