Karnataka court puts interim stay on distribution, sale of book on Tipu Sultan

Amid the ongoing controversy over VD Savarkar and Tipu Sultan, which started in Shivamogga district of Karnataka, a state court has temporarily banned the sale and distribution of books on Tipu Sultan in the state. The trouble started when two groups got into a heated argument over the installation of a banner bearing the picture of Hindutva icon Vinayak Damodar Savarkar and 18th-century Mysore ruler Tipu Sultan at Ameer Ahmed Circle on the occasion of Independence Day.

A lawsuit was filed by BS Rafiullah, former chairman of the District Waqf Board Committee, claiming that the book contained false information on Tipu without any support or justification from history. He also said that the word “TurukaruDerogatory remarks against the Muslim community have been used in the book.

He argued that the publication of the book would lead to unrest and communal disharmony, leading to a breach of public peace on a large scale. Accepting their arguments, the Court said, “If the contents of the play are false and contain false information about tipu sultanand if the same is distributed, it would cause irreparable damage to the plaintiffs and is likely to disturb communal peace and harmony and endanger public tranquillity.”

“If the book is circulated till the appearance of the defendants, the very object of the application will be defeated. It is common knowledge that controversial books sell like hot cakes. Therefore, the balance of convenience at this stage is in favor of the plaintiff In ordering the injunction,” the judge observed.

The court issued contingency notices to all the three defendants and adjourned the matter till December 3. Muslim groups had earlier protested against the book.
