NS National Testing Agency (NTA.)) on Monday sought urgent hearing of its plea against the High Court’s order not declaring NEET 2021 results and conducting re-examination for two candidates whose question papers and OMR sheets were mixed in a center in Maharashtra.
In an unprecedented order, the Bombay High Court on October 20 directed the NTA, which was constituted in 2018 National Eligibility Entrance Test (NEET) For admission to undergraduate medical courses, to conduct fresh examinations for two students and to declare their results along with the mains of the examination held on September 12.

The High Court had taken note of the fact that the test booklets and OMR sheets of two medical candidates Vaishnavi Bhopali and Abhishek Shivaji got mixed up at the examination center before the commencement of the examination and ordered that they be given a fresh chance to appear. Informing about the urgency of the matter, Solicitor General Tushar Mehta, appearing for the NTA, told a bench headed by Chief Justice NV Ramana that the declaration of results is being withheld due to the High Court order.
The court asked the law officer to mention the matter before the bench hearing these matters and on being told that the matter was fresh, the bench agreed to consider listing immediately. The declaration of the result of NEET exam has been stalled at the behest of two students. I am requesting the hearing tomorrow, the Law Officer submitted before the bench, also comprising Justice Surya Kant and Justice Hima Kohli.

“We will see,” said the bench. The NTA, in its appeal, said that the NEET (UG), 2021 examination for more than 16 lakh candidates has been conducted on September 12, and due to the High Court order, they have not been able to declare their results even though they are the same. The plea said that the delay in the declaration of the result of NEET (UG) 2021 will affect and delay the subsequent process of admission to undergraduate medical courses i.e. MBBS, BDS, BAMS, BSMS, BUMS and BHMS courses. Both the students said that the invigilators started distributing the test booklets to all the students at the scheduled time of 1.50 pm.
But, fell down while distributing the test booklet. As a result of this the test booklets and OMR sheets fell down and got mixed up, the petition said. The High Court, apart from ordering re-examination and staying the declaration of results, also directed that the NTA would give 48 hours clear notice to the petitioners regarding the date of examination and the center allotted to the petitioners.

Clarifying that the order would not be treated as a precedent, the High Court had also directed the NTA to issue necessary admit cards or permission for the purpose of appearing for the examination to be conducted in advance. The High Court said that Respondent No. 1 and 2 are advised to frame appropriate rules/guidelines for providing remedial measures in case of such difficulties keeping in view the interest and future of such students.
The NTA said that the NEET entrance exam was conducted on September 12 for 16,14,777 candidates, which included 3,682 centres, 9,548 center superintendent/deputy superintendent, 5,615 invigilators, 2,69,378 supervisors and 220 city coordinators in 202 cities. Argument.
