Bombay High Court on Thursday said on a petition seeking action against the dissidents Shiv Sena leader Eknath Shinde And the other rebel minister was a ‘politically motivated litigant’ and said it would hear the petition if ₹1 lakh was deposited as security.
A division bench of Chief Justice Dipankar Dutta and Justice MS Karnik dismissed the Public Interest Litigation (PIL) filed by journalists, lawyers and students Utpal Chandawar, Abhijit Ghule-Patil, Neelima Vartak, Hemant Karnik, Manali Gupte, Medha Kulkarni and Madhavi Kulkarni.
The petition states, “Due to the current political turmoil in Maharashtra, public rights of citizens are being neglected. This is creating public nuisance for the citizens as Maharashtra ministers are neglecting their duties towards the citizens who have elected them. Instead of working for the community, the ministers are aiming to gain personal gains by provoking internal disorder within the governance of the state. ,
The court said, ‘You have chosen the ministers, you take action. Why should we take notice? Prima facie we believe that this is a purely politically motivated lawsuit. The petitioners have not done the requisite research. We direct the petitioners to deposit one lakh rupees as surety within two weeks.
FIR against Uddhav dismissed
The bench also dismissed another PIL seeking registration of a First Information Report (FIR) against Shiv Sena chief Uddhav ThackerayCabinet minister Aaditya Thackeray and Shiv Sena spokesperson Sanjay Raut.
The petition, filed by Pune resident Hemant Patil, said, “Shiv Sena MLAs, who are rebelling, are camping in Assam due to threats made by Thackeray senior and junior and Mr. Raut.”
“Mr. Raut is a threat to all the 40 MLAs who say that their bodies will come from Assam and will be sent directly to the morgue for post-mortem. In this way all of them are creating a situation of riots and violence in the state of Maharashtra.” The plea had requested the court to direct the registration of an FIR under sedition against the trio, while it was temporarily suspended by the Supreme Court.
