SC agrees to form constitution bench to hear petitions on polygamy, nikah halala

New Delhi: The Supreme Court on Thursday agreed to set up a constitution bench to deal with petitions related to polygamy and nikah-halala, prevalent among Muslims.

A bench headed by Chief Justice of India DY Chandrachud said it would constitute a new bench to deal with the issues.

The court’s direction came after advocate Ashwini Upadhyay mentioned the plea seeking ban on Nikah Halala and polygamy this morning.

Advocate Upadhyay informed the court that two judges – Justice Indira Banerjee and Justice Hemant Gupta – have retired and a new bench is to be constituted.

A five-judge bench of Justices Indira Banerjee, Hemant Gupta, Suryakant, MM Sundresh and Sudhanshu Dhulia was hearing the matter.

The court was hearing a plea seeking to declare polygamy and nikah-halala practiced among Muslims as illegal and unconstitutional.

The practice of nikah-halala requires a divorced woman to marry someone else, consummate the marriage, and then obtain a divorce in order to remarry her first husband under Muslim personal law.

On the other hand, polygamy is the practice of having more than one wife or husband at the same time. (ANI)
