SC refuses to entertain the Waqf Act challenging the latest petition

New Delhi: The Supreme Court on Friday refused to entertain a new petition challenging the constitutional validity of the Waqf (Amendment) Act, 2025.

Chief Justice Sanjeev Khanna and Justice Sanjay Kumar and KV Vishwanathan, a bench, are scheduled to hear petitions on the issue on 5 May. The bench, which had earlier made it clear that it would listen to only five of the more than 70 cases, today again said that no other fresh argument would be given on this issue.

“If you have some additional base, you can enter an intervention application,” the CJI told the lawyer of the petitioner Mohammad Sultan.

On 29 April, the bench refused to entertain 13 petitions challenging the constitutional validity of the Act.

“We are no longer going to increase the number of petitions … it will continue to pill and it will be difficult to handle,” said this.

On 17 April, the bench decided to listen to only five arguments before this and gave the title of the case: “In RE: Waqf (Amendment) Act, 2025”. The Center then assured the bench, it would neither represent the Waqf properties, including “user by Waqf”, nor will make any appointments in the Central Waqf Council and Boards until May 5.

About 72 petitions were filed against the law. These included AIMIM leader Asaduddin Owaisi, All India Muslim Personal Law Board (AIMPLB), Jamiat Ulama-e-Hind, Dravida Munnitra Kazagam (DMK) and Congress MPs Imran Pratapgari and Mohammad Jabde.

While appointing three lawyers as a nodal lawyer, the bench asked the advocates to decide who is going to argue.

“We clarify that the next hearing (5 May) will be for early objections and an interim order,” the bench said.

The Center recently informed the Act, in which the consent of President Dropdi Murmu on 5 April, after he was passed in Parliament after a hot debate in both houses.

The bill was passed with voting in favor of 128 members in the Rajya Sabha and opposing 95. It was approved by the Lok Sabha with 288 members and against it with 232 members.
