Supreme Court has agreed to hear today’s petition Cyrus Mistry While upholding the decision of the top court to remove him as its chairman, the Tata group sought removal of the remarks made against him.
The top court has decided to post the matter for hearing after 10 days.
The Supreme Court will hear in open court on March 9 the review petition filed by the Shapoorji Pallonji Group challenging the apex court’s decision in the dispute between Tata Sons Ltd and Cyrus Mistry in which the court ruled in Tata’s favour.
A three-judge bench of Chief Justice NV Ramana and Justices AS Bopanna and V Ramasubramaniam said, “Applications seeking oral hearing of the revision petitions are allowed. List the review petitions on Wednesday, March 9, 2022.”
Justice Ramasubramaniam, however, ordered dissent, observing that the grounds raised in the petition do not fall within the purview of the criteria for review.
“With the utmost respect, I regret my inability to agree to the order. I have gone through the review petitions carefully and I do not find any valid ground to review the decision. Not within the grounds raised in the review petitions The applications seeking a review and therefore an oral hearing deserve to be dismissed,” Justice Ramasubramaniam said in his dissenting opinion.
This order was passed on 15 February.
The apex court, in its March 26, 2021 judgment, had set aside the December 2019 order of the National Company Law Appellate Tribunal (NCLAT), which had reinstated Cyrus Mistry as the chairman of Tata Sons Ltd.
The NCLAT, in its December 2019 judgment, had held that the proceedings of the board meeting of Tata Sons held on October 24, 2016, to remove Cyrus Mistry from the post of chairman, was illegal.
The Shapoorji Pallonji Group and Cyrus Mistry had approached the apex court in April 2021, seeking a review of the March 26 judgment which backed the decision to remove him as chairman of Tata Sons.
Mistry, who was the sixth chairman of Tata Sons, was removed from the post in October 2016. He took over as chairman in December 2012 after Ratan Tata announced his retirement. N Chandrasekaran later took over as the executive chairman of Tata Sons.
A bench of the then Chief Justice of India SA Bobde and Justices AS Bopanna and Ramasubramaniam had said in the judgment that it was appropriate to remove Mistry from the post of not only the acting chairman but also the director.
