SC to pronounce verdict on Tuesday on plea to increase compensation amount for Bhopal gas tragedy

A five-judge constitution bench in the Supreme Court will on Tuesday pronounce its verdict on the Centre’s judicial plea to enhance the compensation amount in the 1984 Bhopal gas tragedy. On January 12, a five-judge constitution bench had reserved the verdict after hearing for three consecutive days. A curious petition was filed by the Central Government to get an additional globber of Rs 7400 crore to Bhole Gas Dosh. The government wants this money to be given to the union irregular gas scandal.

The Supreme Court has said that apart from the agreement made in 1989, it will not pay a single penny except Bhopal gas. The constitution bench comprises Justice SK Kaul, Justice Sanjeev Date, Justice AS Oak, Justice Vikram Nath and Justice JK Maheshwari. In fact the Center had filed a curative petition in the Supreme Court in 2011 seeking additional compensation for the Bhopal Gas Tragedy charge. The Center has said that the US-based union unregulated company, which is now owned by Dow Chemicals, has been directed to give an additional flyover of Rs 7413 crore.

The petition, filed in December 2010, seeks a re-examination of the High Court’s February 14, 1989 judgment, which awarded US$470 million (Rs 750 crore) to crores of rupees. According to the central government, the earlier settlement was based on incorrect assumptions on the number of deaths, injuries and damages, and subsequent damages were not taken into account. These were based on earlier figures of 3,000 deaths and 70,000 injuries. The curative petition put the death toll at 5,295 and the number of injured at 527,894.
