Setalvad and Sreekumar were in police custody since June 26 on a court order, as they were arrested a day earlier on charges of fabricating conspiracy evidence for the 2002 Gujarat riots.
After being produced in the courtroom, Judge Chauhan asked both the accused whether they had any complaint regarding the period of custodial interrogation. To this Setalvad said that he had to give statements on some occasions but for this he was kept in custody for six days. “There were always five-six cops on guard as if I am a very dangerous person,” she said.
Sreekumar requested the court to direct the investigators to record his statement, at least under the provisions of section 164 (statement recorded by a magistrate) of CrPC. The magistrate rejected the request and said that there is no provision under the law that an accused can insist on recording his statement.
