Supreme Court Collegium, led by Gavai, decided to transfer 22 HC judges, height of 3

New Delhi: The top five judges of the Supreme Court discussed the possible transfer of various High Court judges across the country on Monday. At least 22 transfer between the members of the collegium, led by the Chief Justice of India, was discussed, the bra has learned.

According to Supreme Court sources, the high-power appointment panel does not have to make a final call.

In addition to finalizing the transfer of High Court judges, it approves the names of judicial name in the five -member collegium Supreme Court and approves the chief judicials for the High Courts across the country.

On the other hand, a separate CJI-LED panel, which has two senior judges at the level below CJI, as its members recommends appointments to HCs.

On Monday, five-member collegium, sources said that ThePrint said, “On transfer options, given several factors, some are one of the primary people with a shortage of senior judges in HCs.

One of the sources of sources, one of the sources said, “A lot of views have gone into these transfer – it has been proposed to take care of the situation where HCS does not have senior judges to lead them. Senior judges have either been elevated or shifted as Chief Justices,” said one of the sources.

Transfers are also instead of using the experiences of senior judges in other HCs where they have already served. “We all want to have diversity in HC,” another source said, “All these transfer came to discuss the HC judges in confidence.”

Delhi will see an improvement, along with four senior HC judges will be transferred to the capital. Judges sitting from Allahabad, Punjab, Haryana and Bombay will probably come to Delhi. Allahabad HC Judge, who appointed February 2017, will possibly be part of the Delhi HC Collegium.

The source said, “In Delhi, there is a lot of difference between the experience between the current Chief Justice and the judge below it. To bridge the gap, we are considering some more senior judges in Delhi,” the source said.

The transfer would be implemented within the next three to four days, another source said that the SC collegium has sought consent from the proposed judges for transfer and invited opinion from sitting with judges of the apex court related to HCS, where the transferred judges will go.

The transfer has three to four cases of reversion of judges for its original HCS. The source said, “These transfer was approved by the earlier collegium and was done months ago. When received the requests of the judges, we decided to apply them appropriately,” the source said.

Bombay HC Judge Seniors to reach SC

The five -member panel also approved three HC judges for height in the Supreme Court. If notified by the Center, their appointment will fill the current three vacancies in the apex court. While two out of three judges HC serve as the chief Justice, one is a judge from a Bombay HC.

He is the Chief Justice of Justice NV Anjaria, Parents HC Gujarat and now Karnataka HC Chief Justice and Justice Vijay Bishnoi, originally Chief Justice of Rajasthan and now Chief Justice of Gauhati HC. Both judges, sources said, are senior and selected, in addition to capacity and ability, given that their parents do not have sufficient representation in the top court of HC.

Third appointment, Justice Atul S. of Bombay HC. Chandurkar, below the Chief Justice, has the highest number of judges in their High Court at one level. He served two senior Bombay judges as the Chief Justice in HCS. One of them, Justice Nitin M. Jamdar is the Chief Justice of Kerala HC, and second, Justice KR Sriram, Madras HC’s Chief Justice.

According to sources, the collegium prioritized Justice Jamdar and Sriram to Justice Chandurkar as they will have a long term in the apex court and possibly part of the SC Collectorate in 2030.

The collegium also recommended a swap between the Chief Justice of Rajasthan HC and the Chief Justice of Madras HC. In addition, it recommended the Chief Justice of Jharkhand HC to the Chief Justice of Tripura and Tripura HC to Telangana.

Five new main judicial judges are Justice Sanjeev Sachdeva, who is currently the acting Chief Justice of Madhya Pradesh HC, who will now become the Chief Justice among the MP. Justice Vibhu Bakhru, Delhi HC will take over as the Chief Justice of Karnataka HC, and Judge Chief Justice of Patna HC, Justice Ashutosh Kumar, will go to Gauhati as Chief Justice.

Justice Vipul Pancholi, who was transferred from Gujarat HC to Patna HC, will become the new Chief Justice in Patna, and Judicial Taralok Singh Chauhan, who is now serving in Himachal Pradesh HC, will go to Jharkhand as Chief Justice.

Center informs the appointment of 7 new HC judges

In another important development, the Center on Monday informed the appointment of seven judges in five HCS. Significantly, except for one, the names were pending with the government for a long time.

Post-notifications, three lawyers-deak Khot, Amit Seth, and Pawan Kumar will take oath as judges of Dwivedi-Madhya Pradesh HC. The SC Colgentium approved his name more than a year ago. Seth’s name was sent in October 2023, while the panel approved Khot and Dwivedi in January 2024.

HC of Punjab and Haryana, Bombay, Gauhati and Uttarakhand also received a judge. A source in the Supreme Court said that these appointments were approved due to the efforts of CJI Gawai, who impressed the center to inform the names cleaned by the SC collegium.
