Sharing an update on the EPIC case, Tata Consultancy Services Limited (TCS) reported that in the EPIC Systems Corporation case, the US District Court for the Western District of Wisconsin passed an order reducing the jury award of punitive damages to $140 million and instructed the clerk. To file a revised judgment of the Court accordingly.
“TCS is legally advised that there are strong arguments in its favor before the Court of Appeal and the order on punitive damages is not supported by the facts presented by TCS before the Trial Court. We have been advised that the order and judgment (when is issued) is appealable at the US Court of Appeals, 7th Circuit Chicago.” Indian IT Company said in an exchange filing.
The company did not abuse or derive any benefit from Epic’s documents and plans to vigorously defend its position before the Court of Appeal. As an organization, the company is committed to respect and protect its reputation along with proprietary information, TCS added.
In August 2020, an appeals court in the United States has held that $280 million in punitive damages against Tata Consultancy Services (TCS) was excessive in a trade secret lawsuit filed by American medical software company Epic Systems.
According to reports, Epic filed a lawsuit against TCS in 2014 alleging that the IT services company had stolen its intellectual property. In 2016, Epic won a $940 million jury prize.
In 2017, a Wisconsin court judge reduced the amount of the award to $420 million for complying with the cap on punitive damages in such cases. In January 2018, TCS said it provided a $440 million letter of credit to Epic Systems.
In March 2019, the Wisconsin judge, who initially heard the case, reduced the ruling amount, but upheld the decision after an initial appeal by TCS. Later, TCS filed a notice of appeal in the Seventh Circuit Court in Chicago.
