UP elections: BJP Miranpur candidate booked for provocative speech, violating Election Commission guidelines

BJP’s Miranpur candidate for Uttar Pradesh Assembly elections has been booked for allegedly making provocative speeches at an election rally and violating the Election Commission’s guidelines on campaigning, police said on Monday. Kakroli police station in-charge (SHO) Sunil Sharma said that Parsant Gurjar and 40 of his supporters have also been booked for holding a meeting on Sunday without permission.

He said that the meeting took place despite the Election Commission (EC) banning all types of physical gatherings and rallies in view of the COVID situation. In a video clip, Gurjar can be heard appealing to the people of Chorwala village to support the election as the BJP is of Hindus and the opposition Samajwadi Party (SP) is a Muslim party. Sharma said a case has been registered against Gurjar and his supporters after examining the video, which has gone viral on social media. He said the election meeting, which Gurjar is addressing, was held without the permission of the district authorities and in violation of the Election Commission’s guidelines.

Sharma said Gurjar and 40 of his supporters have been charged under Section 125 of the Representation of the People Act (promoting enmity between classes in connection with elections), Section 3 of the Epidemic Diseases Act and Section 51 of the Disaster Management Act. The SHO said he also faces sections 188 (disobedience to order duly promulgated by public servant) and 269 and 270 of the Indian Penal Code, which pertain to doing any act maliciously, unlawfully or negligently, and which he knows have or have reason to believe. There is a possibility of spreading infection of any disease dangerous to life.

Other IPC sections 505(2) (whoever commits an offense at any place of worship or in any assembly engaged in the performance of religious worship) and 171 (offence not belonging to a certain class of public servants) , wears any) Sharma said holds or possesses a token resembling any garment or token used by that class of public servants. In the first phase of elections to be held in seven phases in Uttar Pradesh, polling will be held in Miranpur assembly constituency on February 10.
