The Court of Justice of the European Union (CJEU) ruled on 14 July that VW AG used an illegal defeat device that alters their cars’ emissions at certain temperatures. The ruling also referred to software that was allegedly installed by VW AG to control the recirculation of exhaust gases, reducing emissions of nitrogen oxides that cause respiratory problems in humans.
“A device that ensures compliance with NOx emission limits only in the temperature window, in principle, constitutes a defeat device,” the court said in its statement.
According to the ruling, the software reduced the recrystallization to zero at a temperature of 15 to 33 Celsius. This in turn would increase NOx emissions to well above the EU legal limit. Since temperatures below 15 Celsius are legal, the necklace device was in fact a violation of EU legal limits.
EU Court It also stated that if the device had been fitted strictly to avoid damage to the engine that could lead to an accident, it may not have been illegal. But even in that photo, year-long use of the device in normal driving conditions would have considered it illegal.
Meanwhile, Volkswagen issued a statement saying, “Volkswagen AG confirms its legal position by the decision of the European Court of Justice. Use in VW Group vehicles in accordance with the criteria set forth by the Court of the European Union in its decision.” Temperature windows to be used are allowed.”
